1. Acceptance of Terms

By visiting the Site, creating an account, placing an order, subscribing to any promotional communication, or otherwise interacting with any feature of the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference.

- Collecting or harvesting any personally identifiable information from the Site without authorization;
- Using the Site to send unsolicited communications, spam, chain letters, or other unauthorized advertising;
- Engaging in any conduct that restricts or inhibits any other user from using or enjoying the Site;
- Attempting to decompile, reverse engineer, disassemble, or otherwise attempt to derive the source code of any software used on or in connection with the Site;
- Placing fraudulent, false, or fictitious orders for the purpose of obtaining unauthorized discounts or otherwise abusing our promotional systems;
- Engaging in any activity that could damage, disable, overburden, or impair the Site or our servers.
Violation of any of the above prohibited activities may result in immediate termination of your account, reporting to appropriate law enforcement authorities, and/or pursuit of civil or criminal legal remedies to the fullest extent permitted by applicable law.
5. Ordering, Payment Terms, and Pricing
5.1 Placing Orders
When you place an order through our Site, you represent that you are legally authorized to make purchases using the payment method provided. All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product descriptions, or suspected fraudulent activity.
Once you submit an order, you will receive a confirmation email or on-screen confirmation to the email address or contact information associated with your account. This confirmation does not constitute our acceptance of your order; it is merely an acknowledgment that we have received it. Order acceptance occurs when we begin preparing your order.
5.2 Pricing and Taxes
All prices displayed on the Site are in United States Dollars (USD) and are subject to change without notice. Prices do not include applicable taxes or delivery fees, which will be disclosed to you at checkout before you confirm your order. We make every effort to ensure that our pricing information is accurate; however, if a pricing error occurs, we reserve the right to cancel your order and provide a full refund if payment has already been processed.
Applicable sales taxes will be charged in accordance with federal, state, and local tax laws. The applicable tax rate will be determined based on the delivery or pickup address associated with your order.
5.3 Payment Methods

By providing your payment information, you represent and warrant that you are authorized to use the designated payment method and that you authorize us to charge your payment method for the total amount of your order, including applicable taxes and fees.
All payment transactions are processed through secure third-party payment processors. We do not store complete credit card numbers on our servers. Your payment information is handled in compliance with Payment Card Industry Data Security Standards (PCI DSS).
5.4 Refunds and Cancellations
Due to the perishable nature of food products, all sales are generally final. If you experience an issue with your order — such as receiving incorrect items, items of unsatisfactory quality, or an order that was not delivered — please contact us promptly at [email protected]. We will review complaints on a case-by-case basis and may offer refunds, credits, or replacements at our sole discretion.
Cancellation of an order may not be possible once it has been accepted and preparation has begun. Please contact us as soon as possible if you need to modify or cancel your order.
6. Intellectual Property Rights
All content available on or through the Site, including but not limited to text, graphics, logos, images, photographs, audio clips, video clips, data compilations, software, and the overall design and layout of the Site (collectively, "Content"), is the property of Imos Pizza or its content suppliers and is protected by United States and international intellectual property laws, including copyright, trademark, and trade dress laws.
The Imos Pizza name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Imos Pizza or its affiliates or licensors. You may not use such marks without the prior written permission of Imos Pizza. All other names, logos, product and service names, designs, and slogans on the Site are the trademarks of their respective owners.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its Content solely for your personal, non-commercial use in connection with placing orders and utilizing our food services. This license does not include the right to:
- Modify or copy the materials;
- Use the materials for any commercial purpose or for any public display;
- Remove any copyright or other proprietary notations from the materials;
- Transfer the materials to another person or "mirror" the materials on any other server;
- Create derivative works based on the Content.
Any unauthorized use of the Content or Site immediately terminates the license granted herein and may result in legal action. We reserve all rights not expressly granted in these Terms.
7. User-Submitted Content
If you submit reviews, comments, feedback, suggestions, photos, or other content to us through the Site or any affiliated platform (collectively, "User Content"), you grant Imos Pizza a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media, for any purpose related to our business operations and marketing.
You represent and warrant that you own or control all rights to the User Content you submit, that the content is accurate, and that use of the content does not violate these Terms or any applicable law or regulation.

9. Disclaimer of Warranties
THE SITE AND ALL CONTENT, SERVICES, PRODUCTS, AND OTHER MATERIALS AVAILABLE THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IMOS PIZZA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Site will be uninterrupted, timely, secure, or error-free;
- The results obtained from using the Site will be accurate or reliable;
- The quality of any products, services, information, or other material purchased or obtained through the Site will meet your expectations;
- Any errors in the Site will be corrected.
No advice or information, whether oral or written, obtained by you from Imos Pizza or through the Site, shall create any warranty not expressly stated in these Terms.
Allergen and nutritional information provided on the Site is offered as a general guide only. Menu items may be prepared in facilities that handle common allergens. It is your responsibility to consult with our staff regarding specific dietary needs, restrictions, or allergies. We are not responsible for any adverse reactions resulting from the consumption of our food products.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IMOS PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, LICENSORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
- Your access to or use of, or inability to access or use, the Site or services;
- Any conduct or content of any third party on the Site;
- Any content obtained from the Site;
- Unauthorized access, use, or alteration of your transmissions or content;
- Any errors, mistakes, or inaccuracies of content;
- Personal injury or property damage of any nature whatsoever resulting from your access to and use of our Site;
- Any interruption or cessation of transmission to or from the Site;
- Delayed or failed delivery of food orders due to circumstances beyond our reasonable control.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100.00) OR (B) THE TOTAL AMOUNT PAID BY YOU TO IMOS PIZZA IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by applicable law.
11. Indemnification
You agree to defend, indemnify, and hold harmless Imos Pizza and its parent company, subsidiaries, affiliates, officers, directors, employees, contractors, agents, licensors, service providers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms;
- Your use of the Site, including but not limited to any data or content you submit, post, or transmit;
- Your violation of any rights of a third party, including but not limited to intellectual property rights or privacy rights;
- Your violation of any applicable federal, state, or local laws or regulations;
- Your negligence, willful misconduct, or fraudulent conduct;
- Any claim that your User Content caused damage to a third party.
We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us. You agree to cooperate with our defense of such claims. You will not settle any such claim without our prior written consent.
12. Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of the United States and the applicable laws of the state in which Imos Pizza operates, without giving effect to any choice of law or conflict of law provisions. You agree that any legal action or proceeding arising out of or related to these Terms or your use of the Site shall be brought exclusively in the federal or state courts of competent jurisdiction located in the United States.
To the extent applicable, these Terms are also subject to the following federal laws and regulations:
- Federal Trade Commission Act (FTC Act), 15 U.S.C. § 45 — governing unfair or deceptive acts or practices in commerce;
- Electronic Communications Privacy Act (ECPA) — governing the interception of electronic communications;
- Children's Online Privacy Protection Act (COPPA), 15 U.S.C. § 6501 et seq. — governing the collection of personal data from children under 13;
- CAN-SPAM Act, 15 U.S.C. § 7701 et seq. — governing commercial email communications;
- Americans with Disabilities Act (ADA) — to the extent applicable to our digital services.
If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) and its amendment, the California Privacy Rights Act (CPRA), as well as California's Unfair Business Practices Act (California Business and Professions Code § 17200 et seq.). 13. Dispute Resolution and Arbitration
13.1 Informal Resolution
Before initiating any formal dispute resolution process, you agree to first attempt to resolve any dispute informally by contacting us at [email protected] and providing a written description of the dispute, the relief sought, and your contact information. We will attempt to respond within thirty (30) days. If the dispute cannot be resolved informally within sixty (60) days of the initial notice, either party may proceed to formal dispute resolution as described below.
13.2 Binding Arbitration
EXCEPT FOR CLAIMS THAT QUALIFY FOR SMALL CLAIMS COURT OR INJUNCTIVE RELIEF TO PROTECT INTELLECTUAL PROPERTY RIGHTS, ALL DISPUTES, CLAIMS, OR CONTROVERSIES ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE SHALL BE RESOLVED THROUGH BINDING INDIVIDUAL ARBITRATION, RATHER THAN IN COURT, IN ACCORDANCE WITH THE CONSUMER ARBITRATION RULES OF THE AMERICAN ARBITRATION ASSOCIATION (AAA). The arbitration shall be conducted in the English language. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction.
13.3 Class Action Waiver
YOU AND IMOS PIZZA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR MULTI-PLAINTIFF ACTION OR PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of class or representative proceeding.
13.4 Opt-Out Right
You have the right to opt out of binding arbitration within thirty (30) days of first accepting these Terms by sending a written notice to us at [email protected] stating your full name, address, and a clear statement that you wish to opt out of arbitration. If you opt out, you agree that any disputes shall be resolved in the applicable courts described in Section 12.
14. Term and Termination
These Terms shall remain in full force and effect for as long as you access or use the Site or maintain an account with us. We reserve the right, in our sole discretion, to:
- Terminate or suspend your access to the Site or your account at any time, with or without cause, and with or without notice;
- Refuse service to anyone for any reason at any time;
- Discontinue any feature, product, or service offered through the Site.
Upon termination of your account or access to the Site, all provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, indemnification, and limitations of liability.

15. Changes to These Terms

For material changes, we will make reasonable efforts to notify you through the email address associated with your account, through a prominent notice on our Site, or through other means we deem appropriate.

16. Severability
If any provision of these Terms of Service is held by a court or arbitrator of competent jurisdiction to be invalid, illegal, unenforceable, or in conflict with any applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, it shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect.
The failure of Imos Pizza to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Imos Pizza.
17. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other legal notices or agreements published by us on the Site, constitute the entire agreement between you and Imos Pizza with respect to your use of the Site and our services. These Terms supersede all prior or contemporaneous communications, proposals, representations, and agreements, whether oral or written, between you and Imos Pizza regarding the subject matter herein.
No agency, partnership, joint venture, employment, or franchise relationship is intended or created by these Terms or your use of the Site.
18. Force Majeure
Imos Pizza shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from any cause beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics or epidemics, fire, flood, earthquake, storms, power failures, telecommunications failures, labor disputes or strikes, acts of government, war, terrorism, riots, civil unrest, supply chain disruptions, or any other event or circumstance beyond our reasonable control (each, a "Force Majeure Event").
In the event of a Force Majeure Event, our obligations under these Terms shall be suspended for the duration of the Force Majeure Event, and we shall make reasonable efforts to resume normal operations as soon as practicable.
